Atari Loses Copyright Claim Against RapidShare

A German court has overturned an earlier ruling, giving RapidShare a victory over Atari Europe in a case that focused on piracy. Atari's sued RapidShare over the availability of its game Alone in the Dark on the file-hosting service. The German court originally ruled in favor of Atari, but the subsequent appeal overturned that decision.

"The Higher Regional Court of Düsseldorf acknowledged RapidShare’s efforts against the distribution of material that is protected by copyright and deemed the additional measures required by Atari to be unreasonable or pointless," said RapidShare by way of Ars Technica. "The ruling demonstrates once again that RapidShare is operating a fully legal range and has taken measures against the misuse of its service which go beyond the level that is legally required," said company spokesman Daniel Raimer. "We are confident that copyright holders will gradually come to accept this conclusion."

Atari had asked that RapidShare monitor and block illicit downloads.
