Microsoft Denied Renewal Of Killer Instinct Trademark

The United States Patent & Trademark Office has denied Microsoft the renewal of the Killer Instinct trademark due to potential conflict with a defunct Fox TV show.

The show of the same name only aired one season back in 2005, but the office decided that the trademark descriptions could be construed as similar, and in the end the resulting products might cause confusion.

Microsoft can appeal the decision.

In September, the company moved to renew the trademark.

  • Bring back Killer Instinct! I can't even remember how much time I spent playing Killer Instinct Gold (or how many quarters I lost to Killer Instinct 2).

  • This is complete and utter bull ***. They can't renew the trademark on a game from the 90's because it might be confused with a show that aired in 2005. Who was the moron who made this decision?
  • Really! Didn't this game come put before 2005?  And screw FOX.  I think the people at the USPTO are dumb as hell.  What person/gamer is going to confuse one of the coolest I didn't say best) arcade games with a show that nobody knows about? let alone watched.

    I've been looking forward to this game for a long time.  I really hope they can get it done.

  • What you guys don't remember that show on FOX about the fighting skeleton? He had a dinosaur sidekick and they fought against their enemies a guy made of ice and one made of fire. I think there was also a robot and a two-headed centaur-ish dude. I can see where people might be confused.

  • Just change the c to a K. Killer InstinKt Kombat or KKK for short.
  • That's ridiculous.  The office must be out of their minds.  KI belongs to gaming, not some show no one knows existed.

  • Type Killer Instinct into google and you get the game not the show.
    Google knows who deserves the trademark.
  • This is kinda strange. They are two different types of media and the Killer Instinct game property is older than the television show. They need to hurry up and fix this because I'm ready for this reboot/ remake or whatever it may be.

  • Thats messed up. the game game came out before the tv show. So the tv show should have been in conflict. Killer Instinct sounds like a phrase. If I recall correctly you cant trademark a phrase. I might be wrong.
    Either way I want Killer Instinct back. I loved playing that game on the SNES. Cinder and Glacius where my all time favorite characters.

  • You snooze you lose Microsoft, should have kept the franchise alive when the millions of fans and voluntarily paying customers asked for a sequel or a re-release or a reboot.

  • Well that sucks. I hope Microsoft appeals. I had some fun times with that game and would like to see a new one made, or even an HD remake.

  • We have no idea how FOX got the rights to use KILLER INSTINCT, there could be a hundred scenarios that led them to legally owning it; dissing on FOX really is irrelevant because it's not like FOX made the final decision. Microsoft should apply for an appeal, but it may be less costly to simply come up with a new name for it anyways. It isn't Microsoft's fault either for Rare not trademarking KILLER INSTINCT and keeping that trademark up to date and in place so FOX could not use it. I pretty sure MS would love to have KILLER INSTINCT franchise out to be Xbox exclusive. Frankly if anyone wants to be upset at anyone, then be upset with the US Patent & Trademark Office, as that was one of the lamest verdicts in entertainment history.
