GAME INFORMER "WordJong Sweepstakes”
The following rules and requirements (the “Official Rules”) govern the GAME INFORMER " WordJong Sweepstakes (the “Sweepstakes”):
NO PURCHASE REQUIRED TO ENTER OR WIN. Must 13 years+ older to enter VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW.
1. SPONSORS:
The Sweepstakes is sponsored by Game Informer Magazine (“Sponsor”).
2. ELIGIBILITY:
A. The Sweepstakes is open only to legal residents of any of the 50 United States who satisfy all other eligibility requirements contained herein or applicable by law. B. The following persons are not eligible to enter or win the Sweepstakes: (a) any of Sponsor’s employees, officers, directors or agents; (b) any employee, officer, director or agent of any of Sponsor’s parent companies, subsidiaries or affiliates; or (c) any immediate family member of, or individual residing in the same household as, any person rendered ineligible by the terms of this paragraph. C. The Sweepstakes is void in Puerto Rico and where prohibited or restricted by law.
3. CONTEST DATES:
The Sweepstakes begins at 12:01 a.m. CST on January 18, 2008 ends at 11:59 p.m. CST on February 1, 2008 (the "Sweepstakes Period").
4. HOW TO ENTER:
A. To enter, submit your information at www.gameinformer.com/wordjongsweeps, by submitting your e-mail address, full name and State of residence and birthdate.
B. All entries must be received by Sponsor during the Sweepstakes Period, and any entries received before or after the Sweepstakes Period shall not be valid or considered.
D. Only one entry per person per day. Entries (other than entry by the winner) will not be acknowledged. Entries will not be returned.
F. No purchase or payment is required to participate in the Sweepstakes. A purchase or payment of any kind will not improve your chances of winning.
G. Any person who submits any false information to Sponsors, or who fails to comply with any Official Rules, shall be disqualified from the Sweepstakes and/or from receiving any prize.
H. By submitting an entry, (a) you agree to be bound by all Official Rules without modification, and (b) represent that you are and will continue to be in compliance with all Official Rules.
5. WINNER SELECTION:
A. The Sweepstakes will have four first place (4) winners to be selected by random drawing from all entries (the "Winners").
B. The Winners will be selected during the week following the end of the Contest Period, and those selections shall be final and conclusive, provided that the Winners are in full compliance with all Official Rules. In the event that any Winner is then or later determined not be in full compliance with all Official Rules, substitute Winner(s) shall be selected by random drawing from all originally eligible entries.
C. The Winners shall be notified that they won the Contest by e-mail sent by Game Informer to the e-mail address provided by each Winner with each Winner’s entry (the "Winning Notification"). The Winning Notification shall contain instructions as to how each Winner should proceed to claim the applicable prize. In the event that a Winner fails to claim the applicable prize within Two (2) days following delivery of the Winning Notification, then such Winner shall forfeit such Winner’s entry and such Winner’s prize, and a substitute Winner shall be selected by random drawing from all originally eligible entries.
D. As a prerequisite to receiving a prize, each Winner may be required to execute certain documentation, including without limitation an affidavit to confirm and certify each Winner’s eligibility, a release of liability, and/or a publicity release (the "Winner Documentation"). Each Winner (or, if Winner is a minor, the Winner and Winner’s parent(s) or legal guardian(s)) shall properly execute all Winner Documentation without modification, and return such executed Winner Documentation to Sponsor no later than Seven (7) days following Sponsors’ initial delivery of the Winner Documentation. The return of the Winner Documentation within this required time period shall be solely the responsibility of each Winner; Sponsor is not responsible for any delivery delays or delivery failures.
E. Any Winner’s failure to satisfy any deadline set forth herein, or failure to comply with any Official Rule, will result in such Winner’s forfeiture of entry and prize relating to the Sweepstakes, and a substitute Winner shall be selected by random drawing from all originally eligible entries.
6. PRIZES/VALUES:
A. Subject to each Winner’s compliance with all Official Rules, each first place winner will receive win a copy of WordJong for Nintendo DS.
B. Prizes are not transferable, and no substitute Prizes, whether cash value or otherwise, shall be awarded by Sponsors.
C. Payment of any and all costs, expenses and taxes associated with the Prizes (other than the Prizes themselves) shall be the sole responsibilities of the Winners.
D. The prize has an approximate retail value of $50
E. Odds of winning will depend on the number of eligible entries received.
7. TERMS:
A. Each Sweepstakes entrant (whether or not eligible to win a Prize) by entering the Sweepstakes grants Sponsor the right to print or otherwise use such entrant’s name, photograph, image, voice recording and likeness without further consent and without compensation in connection with Sponsor’s promotion of and publicity relating to the Sweepstakes during or after the Sweepstakes Period, in any and all media, worldwide. The foregoing includes without limitation an agreement by Winner that Sponsor may post the name, image and/or likeness of Winner at any of Sponsor’s websites, including without limitation www.gameinformer.com.
B. All decisions of Sponsor relating to this Sweepstakes shall be final, binding and conclusive on all matters relating thereto.
C. Each Sweepstakes entrant (whether or not eligible to win a Prize), by entering the Sweepstakes, releases, holds harmless, covenants not to sue and forever discharges Sponsor and Sponsor’s employees, officers, agents, affiliates, assigns and successors-in-interest from, against and as to any and all claims, actions, damages, losses, liabilities, costs, expenses, injuries or causes of action of any kind that in any way now or hereinafter may arise from or relate to acts or omissions arising from or relating to (a) the entrant’s breach of any representation or warranty made in connection with the Sweepstakes; and (b) the entrant’s award, acceptance or use of any Prize.
D. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or any rights and obligations of the entrants and Sponsors relating to the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules. Any and all applicable federal, state and/or local laws and regulations are further incorporated herein.
E. By entering the Sweepstakes, each entrant agrees that any and all disputes, claims and causes of action arising out of or in any way related to the Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Minneapolis, MN. Without limiting the scope of any legal release provided herein, under no circumstance will any entrant be permitted to seek or obtain and, by entering the Sweepstakes, each entrant waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
F. Sponsor reserves the right to modify or discontinue the Sweepstakes in whole or part for any reason including without limitation to preserve the integrity of the Sweepstakes, or to disqualify entrants residing in any affected geographic areas in the event that the Sweepstakes is challenged by any legal or regulatory authority. In any such event, neither Sponsor nor any of Sponsor’s affiliates, employees, officers, directors or agents shall be liable to any person disqualified, damaged or affected by such an action.
