Really, uh oh wouldn't something like this allow Microsoft to make a claim for intellectual property rights? Hope not, this type of stuff is fun (like the red truck across dreamwork films) and I hope Microsoft sees it the same way.

Finally been found? This is really old news, the Bungie community found it pretty much right after ODST came out. It was linked to Destiny the moment the name was known.
