Tattoo Artist Sues THQ Over Unlicensed Use Of Tattoo

Tattoo artist Chris Escobedo is suing THQ over the unlicensed use of a tattoo that appears on fighter Carlos Condit in the UFC Undisputed 3. Escobedo is the owner of Elite Tattoo in Arizona, and he created the tattoo that appears on Condit's side.

Polygon reports that the tattoo in question is an original creation by Escobedo, and THQ did not request permission for the tattoo's appearance in the game. Escobedo says he would not have offered permission had THQ reached out to him. According to Escobedo's lawyer, tattoo artists have full creative rights in regard to their work.

  • I'm pretty sure as long as the artist has like proof of copyright, then he has a valid case.

    Not that I really think this is a big deal. Like calm down. You gave a tattoo to a UFC fighter. You probably aren't hurting for money.

  • Um, no. Tattoo artists don't have full creative rights over their work once it is put onto someone's body. Like a user putting a video on YouTube, once it's up it's theirs to use as they see fit. With the only difference here being that he's not allowed to take back the tattoo because it's a product. No one owns part of another person, and that's essentially what this guy is claiming here. Here, people, is a perfect example of selective interpretation of the law. He has the rights to the art by itself, in it's raw form. They didn't use his art by itself though, they used a tattoo as part of the image of a consenting fighter. This guy must be desperate if he's claiming to own the skin of someone who paid him. This is like demanding to be paid if the fighter appears on TV. It's completely asinine. He likely sees games as an easy target because there's no way he'd go after Fox or Spike or whoever it is for compensation.
  • Doesn't it seem logical that once you place your art on the side of a fighter who's profession is to be shirtless constantly, that you would know that your design is going to be used? Plus, when do you think the creators of the game, with enough on their hands already, are going to stop and say "Hey! Did anyone contact all the tattoo artists for permission?! Get on that immediately!"

  • Not only does this guy not have a case, but if THQ, asked him I find it very hard to believe he would have denied it's use in the game. He would have nothing to gain from denying it.
  • Wow, what a tool. This guy better hope he doesn't win this case, because it will be bad news for tattoo artists everywhere. If he can prove that he owns the rights to the artwork that he tattoos on people, than no tattoo artist will ever be able to charge for a tattoo of Mickey Mouse, Bart Simpson, or any other recognizable icon again, because people will have to pay the respective companies for licensing rights.

    Now that I think of it, this guy is most likely a super hypocrite, considering he's probably done his fair share of licensed character tattoos in the past, and he has no problem collecting money on other people's art.

    EDIT: Sure enough, right on his Facebook page is a big picture of tattoo of Luigi and Yoshi that he did. What a hypocrite.
  • This would open a ridiculous can of worms if the court ruled in his favor. Imagine TV shows having to get the rights to every tattoo someone on screen possesses, or a sports broadcast. This would set a terrible precedent.

  • It's times like this that I'm glad the guy who did my tattoo is a socialist Irishman with anarchist leanings who may or may not be on the run from the law. He'd never try something this moronic. Although, he may not like the publicity, come to think of it.
  • Im... pretty sure that once you tattoo someone, its part of them, and they dictate what they want to do with it and the tattoo artist gets to have his work shown. its advertising. FREE advertising.
