Man Sues Ubisoft Over Assassin’s Creed Story

John Beiswenger, author of "Link," has taken Ubisoft to court over claims the publisher lifted story ideas from his novel to create the Assassin's Creed universe.

The complaint, which was filed earlier this week in a Pennsylvania court, outlines many of the similarities between the book and the game. In "Link," the plot introduces the conception and creation "of a device and process whereby ancestral memories can be accessed, recalled, relived, and re-experienced by the user."

Both also include spiritual and religious tones, assassinations, and characters experiencing historical events through their ancestors’ memories. "Ubisoft have directly copied, and directly and contributorily infringed on the whole of Plaintiff’s copyrighted work," the lawsuit claims. "Link" was first published in 2003.

Beiswenger is seeking 1.05 million in damages and up to $5.25 million if the judge rules Ubisoft knowingly infringed on the copyright, in addition to halting the release of Assassin's Creed III and related products.

Ubisoft said it does not comment on ongoing litigation.

It's a HUGE difference between "including assassinations" and "assassins's order". With the logic he uses, you could equally say that "The Dark Brotherhood" from TES is a ripoff of the AC Assassins since they both are assassins and a brotherhood. That argument is invalid IMO. 3. It's also impossible for two people to have similar ideas (/sarcasm). Sure, the animus argument is suspicious, but honestly, that idea was probably not an original concept when he wrote his novel either way. 4. IMO: Assassin's Creed is more about the war between Assassin's and Templars, not about exploring ancestral memories. With Beiswenger's logic we could equally say that Mass Effect is a ripoff from Star Trek combined with Halo and Star Wars. But that's just my opinion...
  • Should Nintendo sue this guy for not only "knowingly" infringing on Link's name, but possibly his story of "A Link to the Past" as well? People need to stop suing, this guy could've actually become a part of the creative process in this game if he wanted to, if he approached Ubisoft properly.

  • I think Ubisoft just innocently thought of the same idea as the author to this book did, seriously I didn't know this book even exsisted until today (and I read a lot of books) how the hell was Ubisoft supose to know and as for halting the release of AC3 thats a really bull**** thing to do thats about it I hope Ubisoft and this jerk come to an agreement one way or the other because I really want to play AC3 and I'll be pissed that a great series has to end because of some jerk.

    Also I know everyone is not a gamer but come on it really took him until NOW after almost 5 years and the 5th game to try and sue Ubisoft.

    Oh yeah i've did some research about his book and it's got some crappy reviews and a 1 star rating HA!

  • ...and almost 5 years since the first game, he never knew Assassins Creed existed? wow man just drop it you just want credit for their success in making "supposedly" your ideas even better. thats like saying Star Trek has the right to copywrite "Warp Speed". practically every space movie has a "warp speed" engine, and anything else that may have been copied for other space movies.

  • Maybe the base of the story is the same but I doubt every other aspect is and that's what  is gonna come up in court and Ubisoft will win the case and he wont get anything. How the Law works AC3 wont be delayed.

  • No way he's going to win, especially if he's threatening to stop the release of the biggest and potentially best Assassins Creed game ever. I'm pretty sure there are also other mediums where environments and memories can be accessed through an interface by a user.
  • This is just another Obama conspiracy to ensure his reelection. He wants to delay the game's release until after the election because it takes place during the Revolutionary War. The last thing Obama wants is for people to remember why this country was founded in the first place and why it used to be great. The author obviously had no problem with Assassin's Creed for the five years that it has been out - That is until Obama White House representatives threatened him with prison time unless he filed this lawsuit. They will also probably pay off the judge to ensure that he wins. OPEN YOUR EYES PEOPLE!!!

  • hi if he wants to sue anything IF we consider any right in claiming the whole Assassins Creed Game series (for installments) , he only can sue for the original Assassins Creed because after releasing that game he had enough time to claim his rights .by not doing so it is assumed that he don't want anything and by the other installment that came after the original game they became registered copyrighted trademarks of UBI. beside if you google Copyright of The United States in page number 8 under the ("102-subject matter of copyright: in general (a) copyright protection subsists,in accordance with the title,in original works of authorship fixed in any tangible medium of expression ,now known or later developed ,from which they can be perceived ,reproduced,or otherwise communicated,either directly or with the aid of a machine or device .works of authorship include the following categories: (1) literary works (2) musical works,including any accompanying words (3) dramatic works,including any accompanying musics (4) pantomimes and choreographic works (5) pictorial,graphic,and sculptural works (6) motion pictures and other audiovisual works (7) sound recordings;and (8) architectural works. (b) in no case does copyright protection for an original work of authorship extend to any idea,procedure,process,system,method of operation,concept,principle,or advisory,regardless of the form in which it is described,explained,illustrated,or embodied in such work.") and as it told in sector (b) UBI, MAYBE, just had get that idea and cast it in its own method and by doing so he can not claim anything because copyright does not support ideas. he sued for using some words in games but what the Copyright law is protecting is the whole work. i mean if UBI had printed or copied a book just like the one he did and made profit on it he can sue for compensations . Ubi just takes the idea and used it for telling a huge story far beyond book authors (LINK) book an imaginations. and as many said before its just an act for money. where is my Hidden Blade.....
  • You can't copyright ideas, only the expression of ideas. Also, if this were true, why wait nine years to say something?  Equity aids the diligent, not those who slumber on their rights.  Next.

  • I've read all the comments and I think that this is an excuse for an unsuccessful writer trying to get his pay day for a book that he surely took it's idea from another person, book or even a TV show(!) as I took the idea of this comment from the other comments on this issue.

  • No!! This guy cannot halt ACIII. Why is he sueing now when Assassin's Creed was already made so many years ago? Just like all the other posters said, He probably just wants money to make up for the failure of a book he wrote. If I ever see his book, I will burn it.

  • thats stupid. Ubisoft probably didnt even read the book or take any ideas from it. They probably came up with the same ideas that was in the book, but the book has not been read.
