Bethesda Lawyers After Fallout Fan Site

Erling Andersen loved Fallout so much he started his own website where he offered Fallout-style posters for fans to download for free. Bethesda did not appreciate this.

Andersen said he registered the domain name Fallout-posters.com last December, only to have Bethesda lawyers contact him weeks later asking for the website to be taken down and for the website name to be handed over.

"Now, I’m not out looking for trouble. I set up the website out of pure 'fandom', and the last thing I wanted – or expected – was to be threatened with a lawsuit by Bethesda," Andersen wrote. "What pisses me off isn’t the fact that they’re looking out for their trademark – as they have every right to do so. What I’m pissed about are large companies abusing their monetary power, hiring global law firms to go after a fan online, immediately threating with a lawsuit.

"Had they had the slighest bit of PR-savyness, they would have shot me a quick personal mail asking me to remove the (supposed) infringing content – and preferrably sent me some nice Fallout-swag as a nice gesture (yes, I am that corrupt)."

Andersen has removed the posters from his website, but still remains the owner of the website name.

Game Informer has contacted Bethesda for comment.

    I love the games, but I am liking Bethesda less and less as a company all the time.

  • All the game companies I love and respect are ruining their good name...one by one...

    I guess it doesn't matter, though. As long as the games are good people(including me) will keep buying them. "Too good to fail"...

  • Bethesda represents everything that sucks about video games today except for online passes. They wanna sue everyone, and they release unfinished games that make you wanna break your t.v. then they make you be the beta tester so they can have you send your save file in so they can "fix" it. Ive said it a million times but im done with bethesda even if they did buy id..I'll completely skip out on doom 4, I dont care.

  • Bethesda should have been voted worst company of 2011. They release crappy, buggy games and then try to sue anything that moves.
  • I like the games that Bethesda makes and some of the ones that they distribute, but these days it seems like they're suing someone every other week, which is freaking ridiculous.

  • So Bethesda (or probably Zenimax) wants to profit massively off of financially ruining the life of an average, middle-class citizen.  How in Satan's (not-so-green anymore) Earth does this make sense?  Are they not satisfied with the MILLIONS of dollars they have made off of the Elder Scrolls series?  WTF do they think they possibly have to gain from suing this guy?  

    I respect that Bethesda makes awesome games and I appreciate that.  But this is pure Bast@rd-face behavior and they totally deserve to be put in their place.  Or if they don't, they should follow the immortal words of Marcus Fenix and eat sh!t and die.  I would gladly trade my 360 and gaming in general for a world totally free of this type of corruption.  

    First the Scrolls controversy now this... Jeez...

  • I wonder what will cost them more money, the loss in sales due to bad PR or the free posters downloaded from this fan's site? Hmmm

  • I think that's awful. Not that Bethesda doesn't have a right to their trademark or anything, but they could have handled it in a way that would make everybody happy. Perhaps lending their trademark to him for a cut of the sales or promoting his artwork in order to promote themselves and their games. What a bummer move they made.

  • What a bonehead move. It's so counter productive to try to prosecute a fan for distributing FREE posters digitally. If anything he's helping spread the fallout name and probably in some way contributing to sales. Going after a fan for something like this? Not good.

  • It's interesting the line developers/publishers will take when it comes to stuff like this. I think if he was making money off of the posters, then sure, it would be a legal issue. But as a fan, creating stuff that is free, I personally don't see a problem. I guess someone should point him in the direction of DeviantArt.com.
