UPDATE: EA has provided us with the following official statement in response to allegations that the "From Ashes" day one DLC for Mass Effect 3 was on the disc:
"From Ashes is a 600 MB+ download with all new content, including the mission on Eden Prime, new dialogue options and conversations with Javik, new cinematics, the Prothean weapon, and new appearances for all squad members. All of the above content was completed while the main game was in certification and are not available on the disc. "As stated previously, in order to seamlessly integrate Javik into the core campaign, certain framework elements and character models needed to be put on disc. We did something similar with Zaeed and Kasumi in Mass Effect 2."
ORIGINAL STORY: From angry fans to defensive developers, everyone seems to have an opinion on Mass Effect 3's day one downloadable content and whether or not it's acceptable. The latest update comes from a fan claiming to have proof that the squad member unlocked in the DLC was on the disc from the start.
Responding to statements from BioWare saying that the "From Ashes" DLC content was not worked on until after Mass Effect 3 was completed and thus couldn't be included on the disc, YouTube user lljkceski created the video below. In it, the fan claims that by changing a single line of code in the PC version of Mass Effect 3, you can unlock the Prothean squadmate for play without downloading the DLC.
You can watch the video below to see the evidence and decide for yourself if you think its damning. Keep in mind that at this point it's basically BioWare's word versus random fan's word -- either way, you're trusting someone without full knowledge of what went on behind the scenes.
For now, I've reached out to EA and BioWare to see if they have any further comments on the day one DLC or the allegations made in this video. I'll update this post if I hear anything back.

I'll just wait for this DLC to pop up on PS+.. Yes people there is a reason to have the thing, and people still do pay for it.
I am tired of hearing people complain that EA is just trying to make money off of the consumer or that the DLC was useless. EA did not make this DLC mandatory, so you have a choice, you can buy it or skip over it. If you bought it and are now angry at EA, you are just angry at how stupid you are, with your poor impulse control. You could have just waited to see reviews on the DLC or not bought it at all. My point is that EA is not forcing you to buy the DLC, you have to choice to but it or not. Some people need to grow up.
Don't care really, it's just such a great game. Such a great, great game... wish I didn't have to work today...
Got to say, don't care. Vote with your wallet if you don't want this stuff.
What gets me is Bioware and EA's decision to release the main game without the ability to import your character from the first Mass Effect. It's been almost a week, and no fix. The games were sold on this feature. It's like Call of Duty not being shipped with multi-player.
I see stories about this DLC stuff all over the place, but this is a much bigger issue. I've never felt so cheated by a product, and I bought a day one, red ring, Xbox 360. At least that worked for a few minutes.

It seems to me like the character Javik (and other skins) is on the disk like the YouTube video showed, but the rest of the DLC remains available only through downloading.
ugh. I hate how people are bitc**** about every freakin thing in this game. To start off, how do we know that this vid is legit? There have been several people doing anything to give this game a bad name (the metacritic a**holes spamming the game with a 1 or 0 score) How do we know this person didn't just create false files to ruin the reputation? I don't believe this person for 1 minute until BETTER proof is revealed. Now Day 1 DLC. That does not bother me. While I do feel like it should be held off until a few weeks after release, I just simply don't care. If I want it i'll but it, If I don't I will not!
Don't believe everything you hear. No one knows if the guy who posted the video has good proof. EA likes messing up games.
I was so pissed about this whole situation but I got the Digital Collector's Edition with From Ashes n all other goodies for £20 so can't really complain :) HUGE bang for buck. Still feel sorry for those who had to pay £50 to get the full experience
It is dirty but completely in their right to do. I have decided to not support EA's actions so I will not be buying it. Simple as that.
Speaking with dollars is much louder than speaking with words when it comes to big businesses like EA.
