The lights are on
The team behind the upcoming Kickstarter adventure title filed a new trademark this month, and it has nothing to do with the project. Double Fine filed a trademark for "The Cave" on February 22. Whatever it turns out to be, it won't have anything to do with the upcoming game.
"While we can’t comment on unannounced projects, we can say that Double Fine’s Kickstarter-funded adventure game has not been started, designed, or even imagined yet," a studio representative told Game Informer. "No trademarks have been filed on its behalf."
The trademark is for computer and video game software, which largely hints this is yet another game in development at the studio.
Double Fine's Tim Schafer and coworker Ron Gilbert recently sat down in a video interview by 2 Player Productions discussing the state of adventure games.

I don't want to get into maybe's, but wasn't their some kind of agreement when the donations were accepted? Either way, you have thousands of givers and one taker who has stated at least a rough idea of what your donations have purchased. I think that if anything were to happen that would be enough to pursue some kind of legal action.
Let's not get ahead of ourselves here. Nobody has done anything wrong, and good faith should be given otherwise.
