The lights are on
Impulse Technology says it created the technology first, and the company would like the courts to do something about it.
The Ohio-based firm claims that Microsoft's motion tracking sensor violates seven of its patents, include those that cover a "wide variety of games where the movement of a player is tracked in three dimensions…and certain exercise games where the motion of the player is tracked to effect movement of a virtual avatar, and the exertion of the user is monitored, including where the tracking of the player is done by the use of a camera."
Other publishers are also named in the suit, including EA, Konami, and Sega, all for making games for the Kinect that also violate the patents.
If the case succeeds, it could affect any number of issues surrounding Microsoft's ability to sell the Kinect and its games, and might also result in significant damages to the software giant.
Like any case, it's likely to be a long time before we hear any final say on how it will turn out. When there is progress on the case, we'll let you know.

Poor Microsoft. First they're a target for all of the whining hardcore gamers... now they're the target of whining tech defenders.
Does Impulse have a gaming console? Or did they do anything to market their own product? Sorry Impulse, bad decision on your part.
They are suing Microsoft, EA, Konami, and Sega and they think they are going to win. Microsoft alone screws up and loses more money then most companies ever see. EA being the highest grossing game company.With Konami and Sega who are up there as well this suit is between some Ohio company and billions of dollars to spend on lawyers. Why doesn't Microsoft say, "I really don't want to deal with this and get all the drama and media back lash. Here is 10 million dollars I was gunna blow designing a new logo and buying new statue, take it and shut up."

Aw well I'm not to fond of kinect anyways. But I would hate to see microsoft hurt to badly from this.

That's like patenting "Webcam technology" which I'm pretty sure is way too broad to be used in a lawsuit.
Same as the 3DS lawsuit...when something creative and with potential comes out, everyone tries to find a way to trash it
Man it's like at least once a month someone is suing some company for "stealing" their idea or whatever stupid case it may be. I get it that they might actually have a case but seriously? You want to go so far as to sue. I believe Cliffy B or some other video game person in the industry was talking about how many innovative technological advances have already been attempted in the past and just didn't sell/work as well as they had originally hoped for. X amount of years later the idea does work/sell and many people get all upset and rage over nothing.
Cool, lets just get rid of the Kinect and get on with creating more games for hardcore gamers that enjoy using a physical controller, ok Microsoft?
Why are they waiting so long to sue them? Either way Microsoft is a great company and will keep most of their customers.
I swear there should be a law where losers of these lawsuits have to pay back court fees and operating cost to the state/federal gov't. But I bet some will sue against that...
I understand that Microsoft may have used SIMILAR technology but i don't it could the the exact same thing the Kinect uses it.

the tech was developed by steven spielbergs film company and a uk university, so how have microsoft violated the patents?
So they feel like the own the idea of motion control in the third dimension?
