Just last week Microsoft’s Aaron Greenburg said that Microsoft Points were “never intended to mislead people.” Apparently one Xbox Live user doesn’t agree, and has filed a lawsuit with the company.Samuel Lassoff, a resident of Horsham, PA, claims that he received a bill from Microsoft for games that he attempted to download over XBLA. InformationWeek reports that due to a “balky download system,” Lassoff’s MS Points were taken but his game was never received.Lassoff’s lawsuit claims that Microsoft "engaged in a scheme to unjustly enrich itself through their fraudulent handling." He also points to “hundreds” of other Xbox users that have been wronged by Microsoft’s alleged breach of contract by paying for games they did not receive.The complainant has a history of lawsuit-filing. Before Microsoft, Lassoff sued Google and an Atlantic City casino. Anybody else ever have issues like this with MS Points?

The title is misleading.... he's not suing them over the points system he's suing them over getting cheated out of money, which if you're defending M$ on this one then boy do I have a deal for you.
This guy is a loser. He has a history of making frivolous lawsuits. The judge is gonna toss this law-suit out along with Lassoff. Microsoft customer service is awful though.

YES! I HAVE! I thought I was the only one. I downloaded Halo Combat Evolved and have yet to receive it even as a digital copy. I called tech support and they continue to feed me the same dribble each and every time.
why not do it like PSN and just use cash for pete's sake, i mean u gotta put in your card info just to buy points anyway so so cut out the middle man and let them buy your stuff cash wise
Yes , I have had problems with the MS crack team of customer service reps . For over 3 weeks I called them at least every other day about why Sonic would only let me play level 1 then tell me to buy the full game to continue . Every time I would have to explain that yes , I did indeed purchase the full game , and they would transfer me to a " manager " who spoke a form of english that I am unfamiliar with . The issue was never resolved and I am stuck with a demo I payed 400 monkey points for ( Thats 5 dollars real money ). My other issue was resolved in a week , I had bought a Halo 3 avatar t-shirt ( I know , facepalm ) when I put it on my avatar it erased my character , stupid me, I did this 5 times before I realized what the problem was , ( you really start to hate that cartoony caricature when you have to keep redoing it ). So once again I called the "experts " at MS , their solution ? They took the t-shirt off the market , thank you for shopping with us , your full refund will stay in our pockets , please continue to to enjoy your stay . So to make a long story short , I am looking forward to getting my PS3 next month .
It is unfair, but the only way I could get DLC. I always pay with a prepaid card, so it's not a problem for me, yet
When the xbox's were having issues with the red ring o' death. Mine had red ringed and MS replaced it in Jan 06. Well it turned out that the one that they replaced it with could not go online. All my live games went back to demo's. I had to send the xbox I just received back to MS. They reimbursed me the 1600 points and sent me my third xbox(out of five).
I had to redownload everything after my red ring disease , I deleted Sonic and redownloaded the full game , which ironically it would let me do , but that didn't fix it , it still is in demo mode . As for not working online , thats not the issue , I have since bought Shadow Complex , and it worked fine ( btw Shadow Complex = greatest arcade game ever IMO ).
the only issue that i have is that i always have to pay for more points than i want to use. i think that is MS's plan though. oh well.

I've never had any problems. Except like what TetoHix said, and coming out with a strange amount left over and unable to buy anything with it. Thus leading me to buy more. But it's no big deal. Sounds like this is one of those people who just looks for a reason to sue people.
Yeah, nothing ever happened to me RE: MS points that was actionable; then again I kind of doubt this lawsuit has any real basis.
Still, the points system sucks; but again, this is not because I think the points are in place to dupe consumers by being confusing, but by being a "carnival tickets" scheme, to keep you stuck with change in a otherwise useless currency. Maybe this and other similar lawsuits will convince MS to just allow people to pay the exact amount of the item they are buying, instead of having to buy some go-between currency first. That's all I want; then they can call them MS points or goofball-bucks or whatever they want; just so long as I can pay for items, not useless currency that's always going to have some useless change left over.
Anything that makes Microsoft lose money makes me happy.

definitely calling them POINTS can be misleading. So it makes it sound like you are earning them, not purchasing them. 80 points to a dollar, quite deceitful really.

i bought a few premium themes before the xbox live makeover, and after the update none of them worked. but, wait... dude sued google? WTF?
