The lights are on
Just last week Microsoft’s Aaron Greenburg said that Microsoft Points were “never intended to mislead people.” Apparently one Xbox Live user doesn’t agree, and has filed a lawsuit with the company.Samuel Lassoff, a resident of Horsham, PA, claims that he received a bill from Microsoft for games that he attempted to download over XBLA. InformationWeek reports that due to a “balky download system,” Lassoff’s MS Points were taken but his game was never received.Lassoff’s lawsuit claims that Microsoft "engaged in a scheme to unjustly enrich itself through their fraudulent handling." He also points to “hundreds” of other Xbox users that have been wronged by Microsoft’s alleged breach of contract by paying for games they did not receive. The complainant has a history of lawsuit-filing. Before Microsoft, Lassoff sued Google and an Atlantic City casino. Anybody else ever have issues like this with MS Points?
Email the author Tim Turi, or follow on Twitter, and Game Informer.
I did have an issue where my DLC wouldn't show up in a game, it was on my harddrive, but also didn't show in my download history. Microsoft customer support told me to delete it and rebuy it and because I didn't have a credit card on file (i.e. have a Gold Live account) they would not refund my MS points. I literally had to buy it twice.
i can see where he is coming from the system for MS point is flawed..it is like the ticket u win in carnivals, you alwyas end up being stuck wth some that u cant use cus there is nothing at the price or amount u have forcing u to buy more there spending more...as for the games not being there, i dont know if he changed hdd but before i think u had to redownload the game but there was an update long ago that just bring ur games to a new hdd cus u have the license info in the hdd or DL games now...
I honestly think gamers need to get their crap in order.
Busy yourselves with playing the games instead of suing everyone....
If Microsoft is cheating people out of money by making them buy it more than once, and the product doesn't show up on their dashboard, then there's actually a good reason to sue them.
As for MS points, I never liked them myself.
wasnt there somthing like this in 08?
Sounds like another sue happy scumbag. The guy might have had issues with downloading his purchase, but there is no way the guy should be entitled to anything more than his purchase and maybe court costs. If this guy is trying to get more, I hope the lawsuit is drawn out and they find in favor of microsoft. I mean seriously, are you going to sue McDonalds because they didn't put your hamburger in the bag? Hope a plane crashes into this guy's house.
Nope, but I am not surprised at the least.
Yes "complainant" sounds far more sophisticated then "plaintiff"
I never had any problems but I only spend MS points on game content or maybe an arcade game rather than movies or TV shoes.
Never had an issue like that, but still, why not just go into your profile and download it again?
I'm just bothered that it's points rather than the actual amount. Maybe they abuse your points to use but... getting the points lost seems totally d-u-m-b.
He has a very big problem. Got one problem - don't worry suing for 200 MS points seems totally fair! Next thing he's gonna sue himself for being a bad employee.
I doubt he'll win. Next he'll sue the US government, or something even more powerful, Disney (shudder)
While I think MS points are dumb, this guy's just a con artist, screw him
I have never had an issue. I think this is just someway this dude can make money quick.
They should just make a currency people can actually understand, like Wii Points or just straight up U.S. currency.
Well, Good luck buddy. My only complaint like most on here is the point value. It's stupid, just make 5 bucks = 5 bucks.
***, I should've done that already. :( Good for him though, I hope he won. Probably did :)
There's been a few times where I had my MS points taken and not given the content I paid for. It wasn't that big of a deal sense both times it was only about 100 points.
I can understand paying for something and not getting your DLC but suing over the fact they use a point system is ridiculous.
I just wish someone from microsoft would kiss me when I'm 'buying' MS points. I just liked to be kissed when I'm getting screwed is all. Its like if I give somebody a $5 bill for four singles. But its a $20. and they give me $16. A**holes
